1. Introduction
Welcome to SecureWallet. By accessing or using our website, services, applications, or tools (collectively, the "Services"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree to these Terms, you may not access or use the Services. SecureWallet provides a platform for checking the security of cryptocurrency wallets and related services. These Terms constitute a legally binding agreement between you and SecureWallet.
2. Eligibility
By using the Services, you represent and warrant that you are at least 18 years old and have the full power and authority to enter into these Terms. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. The Services are not intended for users under the age of 18.
3. Account Registration and Security
To access certain features of the Services, you may need to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account or any other breach of security. SecureWallet is not liable for any loss or damage arising from your failure to comply with this section.
4. Use of Services
Subject to your compliance with these Terms, SecureWallet grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Services for your personal or internal business purposes. You agree not to (a) reproduce, modify, or create derivative works of the Services; (b) reverse engineer, decompile, or disassemble any part of the Services; (c) rent, lease, or sublicense access to the Services; (d) use the Services for any illegal purpose or in violation of any applicable laws; (e) interfere with or disrupt the integrity or performance of the Services; (f) attempt to gain unauthorized access to the Services or its related systems or networks.
5. Prohibited Activities
In connection with your use of the Services, you agree not to:
- Upload, post, or transmit any content that is unlawful, threatening, abusive, harassing, defamatory, vulgar, obscene, or invasive of another's privacy.
- Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.
- Engage in any activity that could disable, overburden, or impair the functioning of the Services.
- Use any robot, spider, scraper, or other automated means to access the Services for any purpose without our express written permission.
- Attempt to gain unauthorized access to other user accounts or to SecureWallet’s computer systems or networks.
- Use the Services to conduct any illegal activity, including but not limited to money laundering, terrorist financing, or fraud.
6. Fees and Payments
Some of our Services are offered for a fee. By purchasing a plan, you agree to pay the applicable fees as described on our website. All fees are non-refundable except as required by law or as expressly stated in these Terms. We may change our fees at any time by posting a new fee schedule on our website. Your continued use of the Services after such change constitutes your acceptance of the new fees.
7. Intellectual Property Rights
All content, features, and functionality of the Services, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, and software, are owned by SecureWallet or its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You may not use, copy, reproduce, republish, upload, post, transmit, distribute, or modify any of the materials without our prior written consent.
8. User Content
You retain all rights to any content you submit, post, or display on or through the Services ("User Content"). By submitting User Content, you grant SecureWallet a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, perform, and display such User Content in connection with providing the Services. You represent and warrant that you own or have the necessary rights to your User Content and that it does not violate any third-party rights.
9. Third-Party Links and Services
The Services may contain links to third-party websites or services that are not owned or controlled by SecureWallet. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that SecureWallet is not responsible or liable for any damage or loss caused by or in connection with the use of any such third-party websites or services. We encourage you to be aware when you leave our Services and to read the terms and conditions and privacy policy of any third-party website or service that you visit.
10. Termination
We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Services will cease immediately. All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
11. Disclaimer of Warranties
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. SECUREWALLET DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM US SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SECUREWALLET, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICES. IN NO EVENT SHALL SECUREWALLET’S TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID TO US DURING THE TWELVE MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY.
13. Indemnification
You agree to indemnify, defend, and hold harmless SecureWallet and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Services, including, but not limited to, any User Content you submit.
14. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in accordance with the American Arbitration Association’s rules. The arbitration shall take place in San Francisco, California. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.
15. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms.
